1.1 What These Terms Cover

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Ketoki AI ("Company," "we," "us," or "our") regarding your access to and use of the Ketoki AI mobile application, including all features, content, and services offered through our application.

• Health Content: All information, recommendations, meal plans, nutrition data, fasting schedules, and health-related guidance provided through the App.
• User Account: The registered account created by a User to access features of the App.
• User-Generated Content: Any content that Users create, upload, or share through our App, including food logs, photos, progress data, and preferences.
• Intellectual Property: All patents, copyrights, trademarks, trade secrets, and other proprietary rights associated with the App and the Company.
• Premium Services: Subscription-based features and services requiring payment.

2.1 How You Accept These Terms

By downloading, installing, accessing, or using the Ketoki AI App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy (incorporated herein by reference). If you do not agree to these Terms, you must not access or use our App.

• Circumvent or attempt to circumvent any filtering, security measures, rate limits, or other features designed to protect the App or third parties.
• Extract, scrape, or systematically collect data from the App, including recipe databases, meal plans, or nutrition information, without our express written permission.

4.1 Account Creation

Certain features require creating a user account. You agree to provide accurate, current, and complete information during registration and to keep this information updated. You may not create more than one account or use an identity other than your own.

4.2 Authentication Methods

We offer multiple authentication methods:

• Apple Sign-In
• Google Sign-In

When you use third-party authentication services, you agree to their respective terms of service.

4.3 Account Security

You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

• Not share your account credentials with others.
• Log out from your account at the end of each session.
• Notify Ketoki AI immediately at contact@datastores.fr of any suspected unauthorized use of your account or any other breach of security.

Ketoki AI cannot and will not be liable for any loss or damage arising from your failure to comply with these security obligations.

4.4 Personal Use Only

Your account is for personal use only. You may not share your account with multiple users. If you are a healthcare professional wishing to use our App with clients, please contact us for enterprise licensing options.

5.1 Not Medical Advice

IMPORTANT: THE KETOKI AI APP IS NOT A MEDICAL DEVICE AND DOES NOT PROVIDE MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT. THE INFORMATION, RECOMMENDATIONS, MEAL PLANS, FASTING SCHEDULES, AND OTHER HEALTH CONTENT PROVIDED BY OUR APP, INCLUDING AI-GENERATED CONTENT, ARE FOR INFORMATIONAL AND EDUCATIONAL PURPOSES ONLY.

The App is designed to:

• Provide general nutrition and wellness information
• Offer AI-powered meal planning suggestions
• Track fasting schedules and dietary habits
• Support your personal health and wellness goals

5.2 Consult Healthcare Professionals

You should always:

• Consult with a qualified healthcare provider before starting any diet, fasting regimen, exercise program, or making any health-related decisions.
• Seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition.
• Never disregard professional medical advice or delay seeking it because of something you have read or received through our App.
• Contact emergency services immediately if you think you may have a medical emergency.

5.3 Individual Responsibility

You acknowledge and agree that:

• You are solely responsible for your health and wellness decisions.
• Ketoki AI does not practice medicine and does not employ licensed healthcare professionals to provide medical services through the App.
• The App's recommendations are general in nature and may not be suitable for your specific health situation.
• Results may vary significantly between individuals.
• You use the App and follow any recommendations at your own risk.

You agree to use the AI Services responsibly and ethically. This includes:

• Recognizing that AI-generated meal plans and recommendations are suggestions, not prescriptions.
• Using AI features for their intended purposes as described in App documentation or interfaces.

• Exercising your own judgment and listening to your body.
• Respecting the limitations and potential risks associated with AI technology.

6.3 Prohibited Behaviors

General Prohibitions

You agree not to engage in, or attempt to engage in, any of the following activities:

• Using our App in any way that violates applicable local, national, or international law or regulation.
• Interfering with, compromising the integrity or security of, or disrupting our App, servers, or networks.
• Attempting to gain unauthorized access to any part of our App, other user accounts, databases, or any systems or networks connected to our App.
• Using any robot, spider, scraper, or other automated means or interface not provided or authorized by us to access our App or extract data (including recipes, meal plans, or nutrition information).
• Impersonating another person or entity, or falsely stating or misrepresenting your affiliation with a person or entity.
• Uploading or transmitting viruses, malware, or any other type of malicious code.
• Collecting or tracking the personal information of others without their consent.
• Engaging in any conduct that restricts or inhibits anyone's use or enjoyment of the App.

Specific AI-Related Prohibitions

You may not use the AI Services to:

• Generate, upload, or distribute illegal, harmful, abusive, harassing, defamatory, obscene, hateful, discriminatory, or otherwise objectionable content.
• Generate content that promotes eating disorders, extreme dieting, or unhealthy weight loss practices.
• Generate content that infringes upon the intellectual property rights or privacy rights of others.
• Attempt to manipulate our AI systems to produce harmful, biased, dangerous, or unethical health outputs.
• Attempt to discover or extract underlying algorithms, models, or training data from our AI systems.
• Use our AI systems or their outputs to develop competing products or services without our express written permission.
• Generate misinformation or disinformation about health, nutrition, or medical topics.
• Use the App to provide professional nutrition or medical services to third parties.

Content Restrictions

You may not upload, share, or input content that:

• Violates any third party's rights, including intellectual property, privacy, or publicity rights.
• Is false, misleading, or fraudulent.
• Promotes dangerous or illegal weight loss methods.
• Contains personal health information of others without their consent.

7.1 Content Ownership

You retain ownership of the intellectual property rights in any content you create, upload, or share through our App ("User-Generated Content"), including food logs, photos of meals, progress tracking data, and personal notes.

However, by submitting User-Generated Content, you grant Ketoki AI a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform such content solely in connection with operating, providing, and improving the App and AI Services (including for training purposes in anonymized or aggregated form, as described in our Privacy Policy).

This license ends when you delete your content or your account, unless your content has been shared with others and they have not deleted it, or it has been used in anonymized or aggregated form for AI training.

7.2 Content Restrictions

You represent and warrant that you own or have the necessary rights and permissions to submit your User-Generated Content and that your content does not:

• Infringe on the intellectual property rights, privacy rights, publicity rights, or other rights of any third party.
• Contain material that is illegal, harmful, threatening, abusive, harassing, defamatory, pornographic, obscene, vulgar, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.
• Promote eating disorders or unhealthy behaviors.
• Contain viruses, malware, corrupted data, or other harmful, disruptive, or destructive files or code.
• Violate any applicable law or regulation.

Ketoki AI reserves the right, but not the obligation, to review, screen, or remove User-Generated Content at any time and for any reason without notice.

7.3 AI Training Data

As detailed in our Privacy Policy, anonymized or aggregated user interactions with our AI features, including meal preferences, dietary patterns, and usage data, may be used to improve and train our AI systems to provide better recommendations for all users. Personal health information is never shared with third parties or used in identifiable form for AI training. Please review our Privacy Policy for more information, including any choices you may have regarding this use.

7.4 Photos and Camera Access

If you grant the App permission to access your camera, you may take photos of meals, food items, or nutrition labels. By uploading photos, you represent that:

• You have the right to share the photos.
• The photos do not contain identifiable information about other individuals without their consent.
• The photos comply with all content restrictions in these Terms.

8.1 Ketoki AI's Intellectual Property

Excluding your User-Generated Content, all rights, title, and interest in and to our App and AI Services, including all associated software, code, algorithms, AI models, recipe databases, nutrition data, designs, graphics, text, images, interfaces, features, functionality, and the overall "look and feel," as well as any updates, upgrades, or modifications thereto, are and will remain the exclusive property of Ketoki AI and its licensors.

These Terms do not grant you any rights to use Ketoki AI's intellectual property except for the limited license granted in Section 3.

8.2 Trademarks

The Ketoki AI name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Ketoki AI or its affiliates or licensors. You may not use these marks without the prior written permission of Ketoki AI. All other names, logos, product and service names, designs, and slogans on the App are the trademarks of their respective owners.

8.3 Recipe and Content Databases

Our recipe database, meal plans, nutrition information, and other content are proprietary and protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from this content without our express written permission.

8.4 Feedback

If you provide Ketoki AI with any suggestions, ideas, recommendations, bug reports, or other feedback regarding our App or AI Services ("Feedback"), you grant Ketoki AI a worldwide, perpetual, irrevocable, royalty-free, fully paid-up, non-exclusive, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such Feedback for any purpose, without any obligation or compensation to you.

9.1 Nature of AI Services

Our App incorporates AI technologies that generate, process, or analyze health and nutrition content based on complex algorithms and machine learning models. These services include:

You acknowledge that AI-generated content, including meal plans and nutrition recommendations, may require verification and should be used with appropriate caution and professional guidance.

9.3 Nutrition Data Accuracy

While we strive to provide accurate nutrition information, we cannot guarantee that all nutrition data, calorie counts, macronutrient breakdowns, or other nutritional information is 100% accurate. Nutrition data may vary based on:

• Food preparation methods
• Ingredient variations
• Portion sizes
• Brand differences
• Database sources

Always read food labels and consult with healthcare professionals for critical dietary needs.

9.4 AI Usage Limitations

We may impose reasonable limitations on your use of our AI features, such as:

• Daily or monthly usage quotas

10.2 Subscription Plans

Premium services are available through various subscription plans (e.g., monthly, annual). By subscribing, you agree to pay all applicable fees and taxes in accordance with the pricing and payment terms presented to you at the time of purchase.

10.3 Payment Processing

Payments are processed through third-party payment processors, typically via the app store (Apple App Store) through which you downloaded the App. By providing payment information, you represent that you are authorized to use the payment method and you authorize us (or our third-party processor) to charge your payment method for the total amount of your purchase, including any applicable taxes and fees.

Payment processing is also handled through RevenueCat for subscription management.

10.4 Automatic Renewal

11.2 App Store Terms

If you download our App from a third-party app store (Apple App Store), your use of the App is also subject to that app store's terms of service. You acknowledge that:

• These Terms are between you and Ketoki AI only, not with the app store provider.
• Ketoki AI is solely responsible for the App and its content (subject to the disclaimers and limitations in these Terms).
• The app store provider has no obligation to provide maintenance or support services for the App.
• The app store provider is not responsible for addressing any claims relating to the App or your use of it.

11.3 Third-Party Content

Some recipes, nutrition data, or other content may be sourced from or licensed from third parties. We strive to provide accurate attribution where required. If you believe content infringes your rights, please contact us at contact@datastores.fr.

12.1 Privacy Policy

13.1 Disclaimer of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL KETOKI AI, ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR:

• LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES;
• PERSONAL INJURY, ILLNESS, OR HEALTH CONDITIONS;
• WEIGHT GAIN OR LOSS;
• ADVERSE HEALTH OUTCOMES;
• ALLERGIC REACTIONS OR FOOD SENSITIVITIES;
• NUTRITIONAL DEFICIENCIES;
• EATING DISORDERS OR PSYCHOLOGICAL DISTRESS;

RESULTING FROM:

• YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE APP OR AI SERVICES;
• ANY HEALTH CONTENT, MEAL PLANS, RECIPES, OR RECOMMENDATIONS PROVIDED THROUGH THE APP;
• ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON OR THROUGH THE APP;
• ANY CONTENT OBTAINED FROM OR THROUGH THE APP (INCLUDING AI-GENERATED CONTENT);
• UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT;
• THE ACTIONS, OUTPUTS, ACCURACY, OR RELIABILITY OF OUR AI SERVICES;
• YOUR RELIANCE ON ANY INFORMATION OR RECOMMENDATIONS PROVIDED BY THE APP;
• ANY FOOD PREPARATION, CONSUMPTION, OR DIETARY CHANGES BASED ON APP CONTENT;
• ANY FASTING, EXERCISE, OR LIFESTYLE CHANGES UNDERTAKEN BASED ON APP RECOMMENDATIONS;
• OR ANY OTHER MATTER RELATING TO THE APP OR AI SERVICES;

WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, STATUTE, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT KETOKI AI HAS BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

13.2 Limitation of Damages

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL KETOKI AI'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE APP EXCEED THE GREATER OF:

(A) THE TOTAL AMOUNT PAID BY YOU TO KETOKI AI FOR THE APP OR PREMIUM SERVICES DURING THE TWELVE (12) MONTH PERIOD IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE LIABILITY, OR

(B) FIFTY EUROS (EUR €50.00).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. ACCORDINGLY, SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

13.3 Health-Related Disclaimer

YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT KETOKI AI SHALL NOT BE LIABLE FOR ANY HEALTH-RELATED CONSEQUENCES, INCLUDING BUT NOT LIMITED TO ILLNESS, INJURY, ADVERSE REACTIONS, WEIGHT CHANGES, OR MEDICAL CONDITIONS, ARISING FROM YOUR USE OF THE APP OR FOLLOWING ANY RECOMMENDATIONS, MEAL PLANS, RECIPES, OR FASTING SCHEDULES PROVIDED BY THE APP.

14.1 "AS IS" Disclaimer

THE APP, AI SERVICES, HEALTH CONTENT, AND ALL CONTENT, FUNCTIONS, AND MATERIALS PROVIDED THROUGH THEM ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED.

TO THE FULLEST EXTENT PERMISSIBLE BY LAW, KETOKI AI AND ITS AFFILIATES DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

14.2 No Guarantee of Functionality

KETOKI AI DOES NOT WARRANT THAT THE APP OR AI SERVICES WILL BE:

• UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS;
• ACCURATE, RELIABLE, OR COMPLETE;
• SUITABLE FOR YOUR SPECIFIC HEALTH NEEDS OR CONDITIONS;
• EFFECTIVE FOR ACHIEVING YOUR HEALTH OR WELLNESS GOALS;

NOR DOES IT MAKE ANY WARRANTY AS TO THE RESULTS THAT MAY BE OBTAINED FROM USE OF THE APP OR AI SERVICES, OR AS TO THE ACCURACY, RELIABILITY, OR CONTENT OF ANY INFORMATION OR SERVICE PROVIDED THROUGH THE APP.

14.3 AI-Specific Disclaimers

WITHOUT LIMITING THE FOREGOING, KETOKI AI SPECIFICALLY DISCLAIMS ANY WARRANTIES THAT:

• THE AI SERVICES WILL MEET YOUR REQUIREMENTS OR PRODUCE SPECIFIC HEALTH RESULTS OR OUTCOMES.
• THE AI SERVICES OR THEIR OUTPUTS (INCLUDING MEAL PLANS, RECIPES, AND RECOMMENDATIONS) WILL BE ACCURATE, COMPLETE, RELIABLE, NUTRITIONALLY ADEQUATE, OR ERROR-FREE.
• THE AI SERVICES WILL OPERATE WITHOUT INTERRUPTION OR IN COMBINATION WITH ANY SPECIFIC HARDWARE, SOFTWARE, SYSTEM, OR DATA.
• ANY STORED DATA, HEALTH INFORMATION, OR AI-GENERATED CONTENT WILL BE ACCURATE, RELIABLE, OR SECURELY MAINTAINED.
• AI-GENERATED MEAL PLANS WILL BE FREE FROM ALLERGENS OR COMPLY WITH ALL YOUR DIETARY RESTRICTIONS.
• FOLLOWING AI RECOMMENDATIONS WILL RESULT IN WEIGHT LOSS, IMPROVED HEALTH, OR ANY OTHER SPECIFIC OUTCOME.

14.4 No Professional Relationship

USE OF THE APP DOES NOT CREATE A DOCTOR-PATIENT, NUTRITIONIST-CLIENT, OR ANY OTHER PROFESSIONAL HEALTH RELATIONSHIP BETWEEN YOU AND KETOKI AI OR ANY OF ITS EMPLOYEES, CONTRACTORS, OR AGENTS.

15.1 Termination by User

You may stop using our App at any time. You can terminate your account through:

• The App's settings menu
• Contacting us at contact@datastores.fr

Termination may result in the deletion of information associated with your account, subject to our data retention policies outlined in the Privacy Policy.

15.2 Effect on Subscriptions

Terminating your account does not automatically cancel your subscription. You must cancel your subscription separately through your app store account settings or the App's subscription management interface.

15.3 Termination or Suspension by Ketoki AI

Ketoki AI reserves the right, in its sole discretion, to suspend or terminate your access to all or part of the App and your account, without prior notice or liability, for any reason or no reason, including but not limited to, if we believe you have:

• Violated these Terms or applicable law
• Engaged in conduct harmful to Ketoki AI, other users, or third parties
• Misused the AI Services or attempted to circumvent usage limitations
• Provided false or misleading information
• Uploaded prohibited content
• Attempted to extract proprietary data or algorithms
• Used the App for commercial purposes without authorization

We may also modify or discontinue the App or AI Services at any time, with or without notice.

15.4 Effect of Termination

Upon termination of your account or access, your right to use the App will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including, without limitation:

• Sections related to intellectual property
• User-generated content licenses granted to Ketoki AI
• Warranty disclaimers
• Indemnity obligations
• Limitations of liability
• Dispute resolution provisions

15.5 Data After Termination

After account termination, your personal data will be handled according to our Privacy Policy. Some data may be retained for legal compliance, dispute resolution, or in anonymized/aggregated form for improving our services.

17.1 Updates to Terms

Ketoki AI reserves the right to update or modify these Terms at any time in its sole discretion. If we modify these Terms, we will:

• Post the modification within the App
• Update the "Last Updated" date at the top of these Terms
• Provide notice through the App or via email for material changes
• Provide an opportunity to review changes before they take effect (where required by law)

17.2 Acceptance of Changes

By continuing to access or use our App after we have posted a modification or have provided you with notice of a modification, you are indicating that you agree to be bound by the modified Terms.

If the modified Terms are not acceptable to you, your only recourse is to:

• Cease using the App
• Terminate your account
• Cancel any active subscriptions

18.1 Entire Agreement

These Terms and our Privacy Policy constitute the entire agreement between you and Ketoki AI regarding your use of the App and supersede all prior or contemporaneous understandings and agreements, whether written or oral, regarding such subject matter.

18.2 Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable for any reason by a court or arbitrator of competent jurisdiction, such provision shall be modified to reflect the parties' intention or eliminated to the minimum extent necessary so that the remaining provisions of the Terms will continue in full force and effect.

18.3 Waiver

No waiver by Ketoki AI of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of Ketoki AI to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

18.4 Assignment

You may not assign or transfer these Terms, by operation of law or otherwise, without Ketoki AI's prior written consent. Any attempt by you to assign or transfer these Terms without such consent will be null and void.

Ketoki AI may freely assign or transfer these Terms without restriction, including in connection with a merger, acquisition, reorganization, or sale of assets.

18.5 Force Majeure

Ketoki AI shall not be liable for any failure or delay in performance under these Terms due to causes beyond its reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.

18.6 Language

These Terms are drafted in English. In the event of any conflict between the English version and any translation, the English version shall prevail.

18.7 Export Control

You agree to comply with all applicable export and re-export control laws and regulations, including the Export Administration Regulations maintained by the U.S. Department of Commerce. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any list of prohibited or restricted parties.

18.8 U.S. Government Rights

If you are a U.S. government entity or using the App on behalf of the U.S. government, the App is a "Commercial Item" as defined in 48 C.F.R. §2.101.
